1 - Acceptance of conditions

The customer acknowledges having read these terms and conditions of sale.

These general conditions of sale govern the contractual relationship between John Foster and his client, both parties fully accept them. These general conditions of sale prevail over all other conditions contained in any other documents, except in the case of a prior explicit or written permission.

2 - Products

Photographs of John Foster shoes can change slightly from the actual colors. In any case if there are errors regarding nuances in photographs, John Foster will not be held responsible. 3 - Order

Each order will be saved in your basket, the product, the exact description and the date of the order. John Foster confirms the acceptance of the customer's order to the email address provided by him. The order will only be confirmed when the order is validated and full payment is received. John Foster may cancel an order from a client in the case of a dispute concerning the settlement of this order. The information given by the buyer when making an order commit him. In case of an error regarding the address of the recipient, John Foster can not be held responsible for the failure to deliver the product.

4 - Delivery

Once the order is confirmed, John Foster agrees to deliver each customer by courier as soon as possible and everywhere in France. As for Europe, the period will be extended by 3 or 4 days.

In addition, for deliveries outside of mainland France, the customer agrees to pay all taxes due on imports of each product (tax law, customs and other taxes). Delivery is made within the timeframe agreed with the customer by delivering the product directly to the addressee, or in the case of his absence, to another person authorized by the customer. Possible delays do not entitle the buyer to claim interest.

5 - Fraud

The information related to your order are subject to an automated data processing with FIA-NET S.A. The purpose of this automated processing of data is to define a level of analysis of a transaction and to fight against credit card fraud.

FIA-NET S.A. and the dealer from whom you purchase are the recipients of the data related to your order. The non-transmission of data related to your order prevents the execution and analysis of your transaction.

The occurrence of unpaid invoices due to fraudulent use of a credit card will lead to the registration of the data relating to your order with respect to said unpaid invoice in a payment incident file implemented by FIA-NET S.A. An irregular statement or an anomaly may also be the subject of a specific treatment.

6 - Exchange

You have 7 days (upon receipt of the items) to make an exchange. In case of exchange or credit, return of the new item(s) in its (their) original package, intact, along with all accessories.

The item will be exchanged by John Foster in a timely manner, and the cost of sending and receiving mail will be shared between the two parties.

7 - Payment

The price charged to the customer is the price indicated on the order confirmation sent by John Foster.

Each transaction is done securely. Only our bank has knowledge of the credit card number.

The order validated by the customer will be considered effective only when the payment centers concerned have given their approval. In thel case of refusal of the bank, the order will be cancelled. The customer will be notified immediately of the cancellation of the order by John Foster.

8 - Dispute

This contract is subject to French law. John Foster will always do what is possible to find an amicable solution with its customers. In the event of a dispute, the customer can contact the Fédération du Commerce et de la Distribution mediation.

Otherwise, the Tribunal de Commerce de Paris has exclusive jurisdiction, regardless of the delivery location and method of payment accepted.

9 - Legal Information

The personal information collected for purposes of distance selling is mandatory, this information is necessary for order processing. The lack of information results in the non-confirmation of the order. According to the Data Protection Act (loi « Informatique et Libertés ») the processing of personal information regarding customers is the subject of a declaration to the Commission Nationale de l’Informatique et des Libertés (CNIL). The Customer has the right (Article 34 of the Act of the 6th January 1978) to access, modify, rectify and delete data concerning him, all of which he can do before John Foster.
